1. Description of the Services

LayerMind offers security‑focused Services that help protect your browsing, devices, and accounts from online threats, including scam detection, malicious‑link blocking, and related security features. The Services may also include AI‑driven capabilities to analyze and detect the sensitivity or risk level of inputted text or content (such as passwords, personal identifiers, or financial information), and to provide alerts or recommendations based on that analysis.

You acknowledge that the Services do not guarantee complete protection from all online threats, and that you remain responsible for your own security and behavior online.

2. User eligibility and use

You may use the Services only if you:

• Are at least 16 years old (or the age of majority in your jurisdiction, if older), and
• Are not barred from doing so under applicable law.

By using the Services, you represent and warrant that:

• All registration information you provide is accurate, current, and complete.
• You will keep that information updated.
• You have the legal capacity to enter into this agreement.
• You will not use the Services for any illegal or abusive purpose.

3. Subscription, billing, and free trials

3.1. Direct payments and subscriptions

LayerMind sells subscriptions directly through our website using a third‑party payment gateway (e.g., Stripe, PayPal, or similar). You enter into the subscription agreement with LayerMind, not the payment provider.

• Certain features of the Services are available only under a paid subscription (monthly or annual, as offered on our website).
• Subscriptions automatically renew at the end of each billing period unless you cancel in advance.

3.2. No refunds

All fees for paid subscriptions are non‑refundable. We do not provide refunds for any reason, including but not limited to:

• Change of mind or buyer’s remorse.
• Continuous use or non‑use of the Services.
• Early cancellation of your subscription.

If a payment is processed and your subscription period has already started, no refund will be issued.

If your payment method fails and your subscription is suspended or terminated, no refund will be issued for any prior period.

You may request details about your current billing status and upcoming renewal via your account settings.

3.3. Cancellation and suspension

• You may cancel your subscription at any time through your account settings on our website.
• If you cancel during a billing period, you will retain access to the paid features until the end of that period, after which your account will revert to the free tier (if available) and you will not be charged again.
• If we reasonably believe you are abusing the Services, using fraudulent payment methods, or breaching these Terms, we may suspend or terminate your subscription immediately, without notice or refund.

3.4. Free trials and abuse prevention

We may offer free trial periods for certain paid plans. During the trial, you may access features that are otherwise paid.

You must not:

• Use multiple accounts or identities to extend or repeat free trials.
• Use automated tools or scripts to generate fake activity or bypass trial limits.
• Share trial credentials or behave in a way that prevents legitimate users from accessing free trials.

If we reasonably believe you are abusing free trials (including repeated sign‑ups, credential sharing, or other abusive behavior), we reserve the right to:

• Block your account, email, or device from starting or completing a new free trial.
• Prevent access to the Services or parts of the Services.
• Terminate your account without refund or compensation.

By using a free trial, you agree that we may monitor your activity and enforce these rules to protect the integrity of our offers.

4. Use restrictions

You may not:

• Reverse‑engineer, decompile, or disassemble the Services or any part of them.
• Copy, modify, distribute, or resell the Services under a similar form or to provide a competitive product.
• Disable or interfere with the security or detection mechanisms of the Services.
• Use the Services to abuse, harass, defraud, or harm others.
• Use the Services to distribute malware, spam, or other harmful content.
• Bypass any access controls or technical restrictions.
• Use the Services to build or help build a service that competes with LayerMind in substance.

If we reasonably believe you have violated these restrictions, we may suspend or terminate your account without notice.

5. Your data and use of content

You retain any rights you have in that content, but you grant LayerMind a limited, non‑exclusive, worldwide, royalty‑free license to process and analyze your submitted content solely to provide and improve the Services, including:

• Detecting threats, scams, and malicious activity.
• Running AI‑based analysis to detect sensitivity or risk level of text or content.
• Providing alerts, recommendations, or simplified summaries based on that analysis.

We do not use your data to train broad commercial AI models or to sell your personal data to third parties.

6. AI‑based sensitivity detection

Our AI features can analyze inputted text to detect:

• Personally identifiable information (PII) or sensitive data patterns.
• Potentially risky or insecure content (e.g., passwords, credentials, financial phrases).

This analysis is automated and used only to:

• Provide risk alerts or recommendations.
• Help you avoid exposing sensitive information.
• Improve security features and detection accuracy.

We do not intentionally store or re‑use your raw sensitive text outside the limited scope needed to provide and operate the Services.

7. Intellectual property

All rights, title, and interest in the Services, including code, design, trademarks, and related technologies, are owned by LayerMind or its licensors. These Terms do not grant you any rights beyond the limited, non‑exclusive license to use the Services as described here.

You may not remove or obscure any copyright, trademark, or proprietary notices in the Services or related materials.

8. Privacy and marketing

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

By registering, you may receive:

• We do not guarantee uninterrupted, error‑free, or secure operation.
• You may encounter bugs, performance issues, or outages due to technical or third‑party issues.
• The Services provide only a general security indication and are not a replacement for your own judgment or additional security measures.

Your use of the Services, including any reliance on alerts or AI‑based outputs, is at your own risk.

10. Limitation of liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from or related to your use of the Services.
• If we are found liable, our total liability in any case will be limited to the amount you paid us for the Services in the 12 months before the claim arose.

Some jurisdictions do not allow certain limitations, so the above may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless LayerMind from any claims, damages, or costs (including reasonable legal fees) arising from:

• Your misuse of the Services.
• Your violation of these Terms or applicable law.
• Your breach of third‑party rights (including intellectual property or privacy rights).

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will:

• Notify you via email, in‑app notice, or by posting a notice on our website.

Your continued use of the Services after the Effective Date means you accept the updated Terms.

13. Termination

You may stop using the Services at any time. You may also cancel paid subscriptions through your account settings.

We may terminate or suspend your access if:

• You breach these Terms or applicable law.
• We are required to do so by law.
• The Services are no longer available in your region or commercially feasible.
• You abuse free trials, subscriptions, or other offers.

Any termination does not affect obligations that accrued before termination (e.g., unpaid fees or continuing confidentiality obligations).

14. Dispute resolution and law

These Terms are governed by the laws of the Republic of Georgia, without regard to conflict‑of‑law principles. Any dispute arising from or relating to these Terms or the Services will be resolved by the courts of Tbilisi, unless other mandatory law applies.

If required by local law, we may allow you to bring claims in small‑claims court or through a consumer‑protection body in your jurisdiction.

15. Miscellaneous

• These Terms, together with our Privacy Policy, form the entire agreement between you and LayerMind regarding the Services.
• If any provision is found invalid or unenforceable, the rest of the Terms will remain in effect.
• We may assign or transfer our rights under these Terms, but you may not.
• No waiver of any right or breach is effective unless in writing.
